Here is a realistic breakdown of what is coming…Obama needs to be impeached, like Bush needed to be. Glass Steagall has to come back, the Patriot Act, which Obama signed for FOUR MORE YEARS needs to be repealed, Homeland Security needs to be broken up. Cynthia McKinney said that in the last election cycle. Ralph Nader spoke truth. Cindy Sheehan did also. For their pains, they were shunned and reviled. Amy Goodman has not had Cindy Sheehan nor Cynthia McKinney on her show since the election of Obama. Remember when Obama raised money from  ”the people”? No lobbyists, the closure of Guantanamo, etc? Now, he is raising a billion, and has finished the sellout to the banks that Bush started. THE PURPOSE OF HIS ELECTION WAS TO CASTRATE THE LEFT. It worked……
This is a plutocracy, and, even, as some on the Left feel, that Obama is trapped, that does not matter…the Police State is coming in under his reign. I do not say Presidency, for the Executive is Supreme, and Checks and Balances can now only be found in checkbooks and scales…not in this political system.

The Senate is set to vote on a bill next week that would define the whole of the United States as a “battlefield” and allow the U.S. Military to arrest American citizens in their own back yard without charge or trial.
“The Senate is going to vote on whether Congress will give this president–and every future president — the power to order the military to pick up and imprison without charge or trial civilians anywhere in the world. The power is so broad that even U.S. citizens could be swept up by the military and the military could be used far from any battlefield, even within the United States itself,” writes Chris Anders of the ACLU Washington Legislative Office.
Under the ‘worldwide indefinite detention without charge or trial’ provision of S.1867, the National Defense Authorization Act bill, which is set to be up for a vote on the Senate floor Monday, the legislation will “basically say in law for the first time that the homeland is part of the battlefield,” said Sen. Lindsey Graham (R-S.C.), who supports the bill.
The bill was drafted in secret by Senators Carl Levin (D-Mich.) and John McCain (R-Ariz.), before being passed in a closed-door committee meeting without any kind of hearing. The language appears in sections 1031 and 1032 of the NDAA bill.
“I would also point out that these provisions raise serious questions as to who we are as a society and what our Constitution seeks to protect,” Colorado Senator Mark Udall said in a speech last week. One section of these provisions, section 1031, would be interpreted as allowing the military to capture and indefinitely detain American citizens on U.S. soil. Section 1031 essentially repeals the Posse Comitatus Act of 1878 by authorizing the U.S. military to perform law enforcement functions on American soil. That alone should alarm my colleagues on both sides of the aisle, but there are other problems with these provisions that must be resolved.”
This means Americans could be declared domestic terrorists and thrown in a military brig with no recourse whatsoever. Given that the Department of Homeland Security has characterized behavior such as buying gold, owning guns, using a watch or binoculars, donating to charity, using the telephone or email to find information, using cash, and all manner of mundane behaviors as potential indicators of domestic terrorism, such a provision would be wide open to abuse.
“American citizens and people picked up on American or Canadian or British streets being sent to military prisons indefinitely without even being charged with a crime. Really? Does anyone think this is a good idea? And why now?” asks Anders.
The ACLU is urging citizens to call their Senator and demand that the Udall Amendment be added to the bill, a change that would at least act as a check to prevent Americans being snatched off the streets without some form of Congressional oversight.
We have been warning for over a decade that Americans would become the target of laws supposedly aimed at terrorists and enemy combatants. Alex Jones personally documented how U.S. troops were being trained to arrest U.S. citizens in the event of martial law during urban warfare training drills back in the 90′s. Under the the National Defense Authorization Act bill, no declaration of martial law is necessary since Americans would now be subject to the same treatment as suspected insurgents in places like Afghanistan and Iraq.
If you thought that the executive assassination of American citizens abroad was bad enough, now similar powers will be extended to the “homeland,” in other words, your town, your community, your back yard.

    Post-9/11, America’s moved steadily toward eroding democracy entirely. Justification given is war on terror hokum. Incrementally, international, constitutional and statute laws have been trashed.
    Equity, justice and other democratic values long ago were abandoned to advance America’s imperium. On May 26, the House voted to abolish freedom entirely – HR 1540, 322 – 96.
    On December 1, the Senate did likewise – S. 1867, 93 to 7. Both versions assure no one anywhere is now safe, including law-abiding US citizens.
    Senate no votes were cast by Thomas Harkin (D. IA), Rand Paul (R. KY), Thomas Coburn (R. OK), Jeff Merkley (D. OR), Ron Wyden (D. OR), Mike Lee (R. UT), and Bernie Sanders (I. VT).
    Of the Senate’s 51 Democrats, only one voted no.
    At issue are Sections 1031 and 1032 of the FY 2012 National Defense Authorization Act – NDAA (S. 1867).
    Section 1031 authorizes indefinitely detaining US citizens without charge or trial. It exceeds previous police state laws. The provision refers to US citizens or lawful resident aliens even though the Constitution protects them. No longer.
    Enactment means anyone anywhere, including US citizens, may be indefinitely held without charge or trial, based solely on suspicions, baseless allegations or none at all.
    No reasonable proof is required, just suspicions that those detained pose threats. Under subsection (b)(1), indefinite detentions can follow mere membership (past or present) or support for suspect organizations.
    Presidents would have unchecked authority to arrest, interrogate and indefinitely detain law-abiding citizens if accused of potentially posing a threat.
    Constitutional, statute and international laws won’t apply. Martial law will replace them.
    Like the companion House bill (HR 1540), detention would be authorized based on alleged prior associations with suspect groups.
    US military personnel anywhere in the world would be authorized to seize US citizens and others.
    Section 1032 requires suspects held in military custody, outside constitutionally mandated civil protections, including habeas rights, due process, and other judicial procedures.
    Presidents could order anyone arrested and imprisoned for life without charge or trial.
    Abuse of power would replace rule of law protections.
    Even someone erroneously arrested and cleared of wrongdoing could be held indefinitely without charge, given non-civil trials, none at all, or sent abroad to torture prison hellholes.
    On November 29, the Senate voted 60 – 38 against Mark Udall’s (D. CO) amendment. If adopted, it would have prohibited the military from arresting and imprisoning anyone anywhere without charge or trial, including US citizens.
    An orderly review of presidential and congressional detention power would have been authorized. Before adjourning, House and Senate conferees will resolve the issue one way or other. Removing harmful provisions is doubtful.
    If not, Obama promised a veto. So far, he’s broken EVERY major promise made. Given enough congressional votes to override him, it hardly matters what he does.
    December 8 is the House’s targeted adjournment date. The Senate date is yet to be announced. Key legislation must be completed before leaving, including resolving language in FY 2012 NDAA.
    Obama must then sign or veto it. Congress returns on January 5. Will he keep his promise or sign the bill to assure defense funding continuity? Electoral politics suggests the latter.
    Moreover, S. 1867 sponsor Carl Levin said Obama officials were involved in drafting the bill. Both sides apparently agreed on final language.
    Some Post-9/11 Background
    On September 18, 2001, a joint House-Senate Authorization for Use of Military Force (AUMF) approved permanent war on humanity. Thereafter, America’s lurched from one to another. Expect more ahead.
    On November 13, 2001, George Bush issued Military Order Number 1. It was a watershed coup d’etat action.
    It authorized presidents to capture, kidnap or otherwise arrest non-citizens (citizens were later included) anywhere in the world based on unproved allegations of involvement in international terrorism. Moreover, it approved holding them indefinitely without charge, evidence or due process rights.
    It stipulated that trials, if held, will be in secret military commissions, not civil courts. Torture obtained evidence is allowed, and appeal rights are denied those convicted.
    Capitalizing on a window of hysteria, numerous laws, Executive Orders, findings, memoranda, and memos, as well as National and Homeland Security Presidential Directives followed (NSPDs and HSPDs). Constitutional rights eroded. Unchecked police state powers hardened.
    On October 26, 2001, 45 days post-9/11, Congress overwhelmingly passed the USA Patriot Act. Civil liberties were eroded, including Fifth and Fourteen Amendment due process rights by permitting indefinite detentions of undocumented immigrants that now apply to anyone anywhere.
    First Amendment freedom of association was compromised. Now anyone may be prosecuted for their alleged association with “undesirable groups.”
    Fourth Amendment protections from unreasonable searches and seizures are gone, including personal privacy rights.
    Unchecked government surveillance powers were authorized to access personal records, monitor financial transactions, as well as student, medical and other records.
    Secret evidence may be obtained lawlessly and withheld from defense lawyers.
    For the first time, “domestic terrorism” was criminalized. It applies to US citizens and aliens. It states criminal law violations are considered domestic terrorist acts if they aim to “influence (government policy) by intimidation, coercion (or) intimidate or coerce a civilian population.”
    In other words, anti-war, global justice, environmental and animal rights activism, as well as Occupy Wall Street activism may be designated “domestic terrorism.” So may civil disobedience and dissent of any kind to prevent it entirely.
    On October 1, 2002, USNORTHCOM’s establishment was step one to militarizing America.
    The November 25, 2002 Homeland Security Act (HSA) centralized unprecedented executive branch military and law enforcement powers.
    The October 17, 2006 Military Commissions Act scrapped habeas protections for domestic and foreign enemies alike, citizens and non-citizens, stating:
    “Any person is punishable… who….aids, abets, counsels, commands, or procures” and in so doing helps a foreign enemy, provides “material support” to alleged terrorist groups, engages in spying, or commits other offenses previously handled in civil courts.
    It also authorized torture and empowered presidents to convene military commissions to try anyone called “unlawful enemy combatants.” They now designated “unprivileged enemy belligerents.”
    On the same date, little know FY 2007 NDAA provisions (Sections 1076 and 333) amended the Insurrection Act of 1807 and Posse Comitatus Act of 1878.
    They prohibit using federal and National Guard troops for law enforcement domestically except as constitutionally allowed or expressly authorized by Congress in times of a national emergency like an insurrection.
    Presidents may now claim public emergency powers, effectively declare martial law, suspend the Constitution for “national security” reasons, and deploy federal and National Guard troops on America’s streets to suppress whatever he calls disorder.
    The key April 4, 2007 NSPD-51/HSPD-20 combined directive established “Continuity of Government (COG)” procedures under Catastrophic Emergency conditions, defined as:
    “any incident (such as a terrorist attack), regardless of location, that results in extraordinary levels of mass casualties, damage, or disruption severely affecting the US population, infrastructure, environment, economy, or government functions.”
    COG is then defined as:
    “a coordinated effort within the Federal Government’s executive branch to ensure that National Essential Functions continue to be performed during a Catastrophic Emergency.”
    The combined directive gave the president and DHS unprecedented police state powers to declare martial law without congressional approval, and be able to rule extrajudicially, free from constitutional constrains. It also let the vice-president assume dictatorial powers. Clever wording marginalized Bush, saying:
    NSPD 51 “shall be implemented in a manner that is consistent with, and facilitates effective implementation of, provisions of the Constitution concerning succession to the Presidency or the exercise of its powers, and the Presidential Succession Act of 1947 (3 U.S.C. 19), with consultation of the Vice President and, as appropriate, others involved.”
    “Heads of executive departments and agencies shall ensure that appropriate support is available to the Vice President and others involved as necessary to be prepared at all times to implement those provisions.”
    Civil liberties were further eroded by institutionalized spying, other forms of surveillance, waging war on Islam, criminalizing dissent, creating a culture of secrecy, militarizing police, punishing whistleblowers, using courts as persecution instruments, and governing extrajudicially overall.
    If FY 2012 NDAA includes Sections 1031 and 1032, America more than ever will be repressive and unfit live in.
    How can it be if constitutional, statute and international law protections no longer apply.

    Obama Should Veto Empire Over Republic

    The political, military industrial, corporate class in Washington DC continues to re-make our constitutional republic into a powerful, unaccountable military empire. Yesterday the U.S. Senate voted 93 to 7 to pass the National Defense Authorization Act (NDAA) for Fiscal Year 2012 which allows the military to operate domestically within the borders of the United States and to possibly (or most probably) detain U.S. citizens without trial. Forget that the ACLU called it “an historic threat to American citizens”, this bill is so dangerous not only to our rights but to our country’s security that it was criticized by the Directors of the FBI, the CIA, the National Intelligence Director and the U.S. Defense Secretary! For the first time in our history, if this Act is not vetoed, American citizens may not be guaranteed their Article III right to trial.
    The government would be able to decide who gets an old fashioned trial (along with right to attorney and right against self-incrimination) and who gets detained without due process and put into a modern legal limbo. Does anyone remember that none of the first thousand people the FBI rounded up after 9-11, and which were imprisoned for several months (some brutalized) were ever charged with terrorism? Does anyone remember that hundreds of the Gitmo detainees who were handed over to their American military captors in exchange for monetary bounties were found, after years of imprisonment, to have no connection to terrorism?
    When in doubt about a case, what do you think the government will again do? Does it prefer to submit its evidence to a jury’s scrutiny and its witnesses to the trouble of being cross-examined in court by a defense attorney or would it be easier to have no questions asked and dump the accused into detainee prison without rights? I think we already know that answer from the nearly ten years of experience at Guantanamo.
    Senator Lindsey Graham declared that suspected citizens open themselves up “to imprisonment and death”. “And when they say, ‘I want my lawyer,’ you tell them: ‘Shut up. You don’t get a lawyer.’”
    Of course, the politicians will say we are just talking about a few cases. But in fact the sky’s probably the limit given the current legal ambiguity in the Patriot Act expansion of “material support for terrorism” to now include humanitarian aid and even mere advocacy speech without any need to prove an accused person intended to support any kind of terrorist violence. The Department of Justice has been currently using this ambiguity for over a year to investigate twenty three American citizens who are anti-war activists in Chicago and Minneapolis. Additionally, the “war on terror” will undoubtedly expand even more when it is de-linked from 9-11 — see “The War on Terrorism Congress Never Declared — But Soon Might” by Stephen I. Vladeck, a law professor, expert on these issues and associate dean for scholarship at American University Washington College of Law:
    … an individual may be detained for providing “direct support” (which, in the government’s view, may be nothing more than minor financial or logistical assistance) in aid of “associated forces” that are “engaged in hostilities against … coalition partners.” Thus, the NDAA effectively authorizes the military detention of any individual who provides such assistance anywhere in the world to any group engaged in hostilities against any of our coalition partners, whether or not the United States is in any way involved in (or even affected by) that particular conflict.
    Given this expansion of the 2001 Authorization to Use Military Force contained in the 2012 NDAA to encompass undefined “associated forces”, we could witness the US government targeting a large range of political dissidents, human rights activists, humanitarians, and maybe even “occupiers”.
    The NDAA is deliberately confusing for political purposes but much is at stake. Obama’s determination as to whether or not he will veto the problematic 2012 war funding bill will determine how Benjamin Franklin’s glib response to the woman waiting outside the Constitutional Convention is ultimately answered. Franklin and other founding fathers had created “a Republic, Madam, if you can keep it”. But a lawless Military Empire could now await where U.S. “emergency war powers” trump the Constitution, where the Commander in Chief becomes king for a term(s), the military enters into police state actions in violation of 130 years of Posse Comitatus law, and the Constitution becomes as quaint as the Geneva Conventions were for Alberto Gonzalez and the Bush Administration.
    Corrupted, compliant politicians have already allowed their fears to get the better of them by going along with pre-emptive war in violation of the Nuremberg Principles and international law and torturing in violation of the Geneva Conventions and the Convention against Torture. So why should they also not go for detaining American citizens without constitutional rights or trial?
    Tell your congresspersons and senators who passed the NDAA they should be ashamed and tell the president (also via Senator Mark Udall’s petition) he needs to keep his promise to veto this Act in order to save our Republic.

  8. Sen. Kelly Ayotte is the man who is behind the bill to roll back torture prevention. Oddly enough Sen. Kelly Ayotte (R-N.H.) endorsed former Massachusetts Governor Mitt Romney for the Republican presidential nomination.
    Romney is a backer of enhanced tortures, put in place by his fellow Mormon Church members under Mitchell and Jessen. Mitchell and Jessen were brought into the CIA by Cofer Black. Black is a Romney backer and part of the Romney for president team.
    Could Sen. Ayotte be preparing for a Romney in the White House and helping his bud out by putting laws into place to help Mittens against any voices raised against him.
    Bachmann is on the Congressional Intelligence Committee, which is headed by Mike Rogers (R ) from Brighton, Michigan. One wonders Mike’s influence on Bachmann. The Rogers family are HUGE backers of Mitt Romney, in fact the whole Livingston County GOP loves the Romney family.

    For those who think that Economics is the major and only topic worth vast focus…well, if you live in a Police State, protest and change are impossible. We need the Bill of Rights back, and the deletion of the Patriot Act…which President Obama just signed for Four More Years…even President Bush did not have the nerve to do that. That is because Obama has not opposition, while he raised a billion dollars from special interests (remember when he raised funds from “the people?”). Many have betrayed themselves by refusing to look at the continuous assassinations and False Flags which have occurred in this country. While many sleep, Tom Hanks, who is being called “America’s Historian” is busy making an HBO miniseries based on the LIE of Vincent Bugliosi’s 1700 page book, “Reviling History”, er, sorry, Reclaiming History. Appalling.
    Meanwhile, it has been announced that we have a weapon capable of hitting any point on the Globe within an hour…a Darth Vader Star Wars announcent which was met with nary a whimper.
    Cameras and microphones are being put in millions of street lights…under Obama. The FBI is starting their National Facial Recognition program in January. All of your electronic communications are still being captured, and you are being spied upon 24/7 by Satellites. There are over seventy Fusion Centers in the Homeland…all this is part of convicted Iran/Contra War Criminal’s John Poindexter’s Total Information Awareness Program. The headquarters of Homeland Security in Virginia was completed in 2009…at a cost of 3.4 Billion Dollars, the largest government construction project since the building of the Pentagon. (England, our partner in these illegal wars, the birthplace of Orwell, is suffering a similar fate…ALL of the cabs in London are having listening devices installed, and ALL conversations will be recorded…the poor bastards). How can we commit evil abroad and not have it redound and rebound on us in the Homeland? Houston Police just deployed DRONES..equipped with Tasers. The War on Terror was never about that..it was the rationale which allowed the formation of Homeland Security, the Patriot Act, and the deletion of Posse Comitatus and Habeous Corpus.
    With 56,000 Lobbyists, and the announcement, after an Obama visit to Australia of the first permanent military base to be built in that country…in the middle of a spiraling Depression….it is finally time to realize what we are. This is not an attack on President Obama….I was equally hard on President Bush, because this is not about Party, it is about the Corporate/Government Military Media Industrial State, which is paramount no matter which puppet occupies the White House. It IS sad: because so many did not realize that President Obama was NOT an agent of Hope and Change, by not understanding the true nature of the National Security State, and that since they killed JFK that a “made man” would not be allowed anywhere near the center of power, the completion of the Police State under his watch has proceeded with almost no dissent.

    With the bill expected to be up for a vote within 48 hours, Senator Rand Paul has offered an amendment to the National Defense Authorization Act that will kill a provision allowing the military to detain individuals, including American citizens, without trial or due process.
    The “indefinite detention” sections of the NDAA bill would turn the whole of the United States into a “battlefield” and hand the executive branch the power to have the military arrest U.S. citizens and hold them without trial.
    The provision is merely an update to the “parallel legal system” had been in place under the auspices of the war on terror for over a decade, “In which terrorism suspects — U.S. citizens and noncitizens alike — may be investigated, jailed, interrogated, tried and punished without legal protections guaranteed by the ordinary system,” as the Washington Post reported in December 2002.
    In attempt to kill the indefinite detention provision of the legislation, Senator Rand Paul aims to strike Section 1031 from the bill, which reads as follows.
    “Congress affirms that the authority of the President to use all necessary and appropriate force…includes the authority for the Armed Forces of the United States to detain covered persons…Detention under the law of war without trial”.
    The amendment is seen as having more teeth than a change offered by Colorado Senator Mark Udall which the ACLU has urged voters to support. “There are other similar Amendments too, however none of them completely eliminate the Constitutionally offensive section,” reports the Tennessee Campaign for Liberty website.
    Writing in the Washington Post today, Udall emphasizes the fact that the bill does affect American citizens.

    “The provisions would require the military to dedicate a significant number of personnel to capturing and holding terrorism suspects — in some cases indefinitely — even those apprehended on U.S. soil. And they authorize the military to do so regardless of an accused terrorist’s citizenship, even if he or she is an American captured in a U.S. city,” writes Udall.
    Republican Congressman Justin Amash also warned that the bill had been “carefully crafted to mislead the public,” in suggesting that the indefinite detention provision didn’t apply to American citizens when it clearly does.
    “Note that it does not preclude U.S. citizens from being detained indefinitely, without charge or trial, it simply makes such detention discretionary,” Amash wrote on his Facebook page.
    As we documented yesterday, every single piece of legislation passed in the name of catching terrorists has been used against American citizens on countless occasions.
    In an op-ed for the SIlicon Valley Mercury News, S. Floyd Mori, national executive director of the Japanese American Citizens League, warns that the legislation would create the legal framework for internment without trial on a similar scale to how Japanese-Americans were held in concentration camps during World War II.
    “Indefinite detentions based on fear-driven and unlawfully substantiated national security grounds, where individuals are neither duly charged nor fairly tried, violate the essence of U.S. law and the most fundamental values upon which this country was built,” he writes.
    The National Defense Authorization Act is set for a procedural vote at midday on Wednesday.

    Attorneys for Sirhan Sirhan, the man who assassinated Robert Kennedy in 1968, have asked that he be released from prison, alleging that he was a victim of “mind-control” and never actually shot Kennedy.
    Less than a week after the anniversary of the assassination of President John F. Kennedy, Sirhan’s lawyers have presented their own Kennedy conspiracy theory, alleging that in Sirhan’s 1969 trial the court ignored evidence that there were actually two shooters in RFK’s assassination. Sirhan’s legal team is also arguing that the revolver found on Sirhan was not responsible for the gunshots that killed Kennedy.
    “Though the practice of hypno programming/mind control is hardly new, the public has been shielded from the darker side of the practice,” Sirhan’s court filings say. “The average person is unaware that hypnosis can and is used to induct antisocial conduct in humans.”
    Attorneys William F. Pepper and Laurie D. Dusek argue that Sirhan at least deserves a new trial, alleging that the original 1969 proceeding were marred by fraud when the court allowed a substitute bullet to be used in place of the real bullet removed from Kennedy’s neck.
    In addition, Sirhan’s attorneys say recently discovered audio recordings provide evidence that as many as thirteen gun shots were fired at the time of Kennedy’s assassination assassinated. As CNN explains, the details get even stranger from there:
    The attorneys further assert that Sirhan was hypno-programmed to be a diversion for the real assassin and allege that Sirhan would be easily blamed for the assassination because he is an Arab. Sirhan, 67, is a Christian Palestinian born in Jerusalem whose parents brought him and his siblings to America in the 1950s.
    Sirhan “was an involuntary participant in the crimes being committed because he was subjected to sophisticated hypno programming and memory implantation techniques which rendered him unable to consciously control his thoughts and actions at the time the crimes were being committed,” court papers said.
    The California attorney general’s office has so far declined to comment on Sirhan’s court filings.
    Sirhan Sirhan has long claimed that he cannot remember the actual assassination. Harvard Medical School hypno-programming expert Daniel Brown recently worked with Sirhan, claiming to successfully help him remember the assassination for the first time. Brown says Sirhan claims that due to “mind control,” Sirhan believed he was at a gun range shooting at circular targets.
    Pepper and Dusek also represented Sirhan during his recent unsuccessful attempt to win parole from Pleasant Valley state Prison in Coalinga, California, where he is currently serving a life sentence.
